General Corporate Counsel
Moeller Graf represents community associations in all facets of corporate governance, including election and voting issues, amendment of governing documents, interpretation of governing documents, preparation of opinion letters, evaluation of assessment issues, preparation of policies and rules, attending difficult and contentious meetings and handling other corporate issues.
Assessment Collection
At Moeller Graf, we understand that collections of assessments are the life blood
of Colorado community associations. We take pride in our assessment collection
services. Our services include the preparation of collection demand letters,
the preparation and recording of notices of lien, the filing of judicial foreclosure
actions, the use of receiverships and other non-traditional remedies when appropriate,
and the diligent pursuit of post-judgment collection cases. We feel that we have
the best and most experienced collection team available.
Enforcement
Our objective at Moeller Graf is to keep our client communities out of court whenever possible. To that end, we provide pre-litigation and non-litigation enforcement services including enforcement letters and extensive counsel for boards of directors as well as assistance in conciliation efforts. We will, to the extent possible and practical, achieve owner compliance in a cooperative manner.
Litigation
In some instances, the Association must enforce its governing documents through litigation. Moeller Graf litigates governing document enforcement matters and also provides defense to community associations that are sued.
Contract Negotiation and Review
Moeller Graf has extensive experience in negotiating and reviewing contracts and leases between community associations and vendors such as cable providers, management companies, roofing companies, landscapers, and similar vendors.
Arbitration and Mediation
Both Tim Moeller and David Graf provide arbitration and mediation representation.
Construction Defects
Moeller Graf acts as general corporate counsel and, when appropriate, provides a referral to specialized construction defect counsel when community associations need to assert claims against developers or builders. |
