HB19-1050 Expands a Homeowner’s Right to Install Xeriscaping

HB19-1050, which was signed into law on March 7, 2019 will expand a homeowner’s right to install drought-tolerant landscaping in any area that the homeowner owns or has exclusive control over (i.e., a limited common element). The bill expands on section 38-33.3-106.5 of CCIOA by prohibiting an association from prohibiting a homeowner from installing drought-tolerant landscaping from areas the homeowner owns to areas that the homeowners owns and areas within the exclusive control of the homeowner, like a limited common element.
